Consent records: the date, time, method, and wording of any opt-in you give for email, phone, or SMS communications, along with your opt-out history.

When you visit the Site, we and our analytics and advertising partners may automatically collect:

2.3 Communication Metadata

We may receive information about you from advertising platforms, lead generation forms hosted on platforms such as Meta or Google, business data providers, and publicly available sources.

2.5 Information We Process on Behalf of Clients

When we manage marketing campaigns for a client, we may access and process contact information belonging to that client's customers and prospects. In that role, we act as a service provider to the client, and the client's own privacy policy governs how that data may be used. We process it only as directed by the client and as needed to perform the services.

3. How We Use Your Information

We use the information we collect to:

Schedule, confirm, and remind you about consultations and appointments

Provide, manage, and improve our marketing and advertising services

Communicate with you about your projects, campaigns, ad creatives, and account

4. Mobile Information and SMS Data

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Your mobile phone number, your SMS opt-in status, and your consent records are used only to deliver the messages you have agreed to receive and to maintain compliance records. We do not sell, rent, or share this information with third parties for their own marketing use.

We may share mobile information with our messaging infrastructure providers — including GoHighLevel and the telecommunications carriers that transmit the messages — strictly for the purpose of delivering messages you have opted in to receive. These providers are contractually restricted from using the information for any other purpose.

5. Use of GoHighLevel and Other Service Providers

We use GoHighLevel, a third-party CRM and marketing automation platform, to store contact records, manage communications, host forms and funnels, schedule appointments, and deliver email, phone, voicemail, and SMS campaigns. Information you provide to us is stored and processed within that platform and its supporting infrastructure.

We also work with other service providers, including:

Payment processors for client billing

Email delivery and deliverability providers

Telecommunications carriers and messaging aggregators

Advertising platforms such as Meta, Google, TikTok, and LinkedIn

Website analytics providers

Cloud hosting and file storage providers

Scheduling and calendar tools

These providers may access your information only as necessary to perform services for us and are obligated to protect it.

6. How We Share Information

We share personal information only in the following circumstances:

With service providers, as described above, to operate our business and deliver our services.

With clients, where you have submitted an inquiry through a campaign or funnel we operate on a client's behalf. In that case, your information is provided to that client so they can respond to your request.

With advertising platforms, in limited cases, for audience matching and conversion measurement. This never includes SMS opt-in data or mobile numbers collected for text messaging.

For legal reasons, when required by law, subpoena, court order, or government request, or where we believe disclosure is necessary to protect our rights, investigate fraud, or prevent harm.

In a business transfer, if MarkaScaling is involved in a merger, acquisition, or sale of assets, in which case we will notify you of any change in how your information is handled.

We do not sell your personal information. We do not share your personal information with third parties for their own independent marketing purposes.

7. Cookies and Tracking Technologies

The Site uses cookies, pixels, tags, and similar technologies to operate the website, remember your preferences, measure traffic, and support advertising.

SMS. You can stop receiving text messages at any time by replying STOP to any message from us, or by texting STOP to 484-343-8407. You will receive one confirmation message and then no further texts. Reply HELP for assistance, or contact [email protected].

Phone calls. You may ask to be added to our internal do-not-call list by contacting us at [email protected] or 484-343-8407.

Access, correction, and deletion. You may request a copy of the personal information we hold about you, ask us to correct inaccurate information, or ask us to delete your information. Contact us at [email protected]. We will respond within the timeframe required by applicable law. We may need to verify your identity before acting on a request, and we may retain certain records where required by law — including opt-out records, which we keep so we can honor your request going forward.

Client-managed data. If your information was collected through a campaign we operate on behalf of a client, we will forward your request to that client, who controls the data.

9. State Privacy Rights

Residents of California, Virginia, Colorado, Connecticut, Utah, and other states with comprehensive privacy laws may have additional rights, including the right to know what personal information is collected, the right to request deletion or correction, the right to opt out of the sale or sharing of personal information and of targeted advertising, and the right not to be discriminated against for exercising these rights.

MarkaScaling does not sell personal information and does not share personal information for cross-context behavioral advertising in the manner defined by the California Consumer Privacy Act.

10. Data Retention

Call recordings and message logs: typically retained for up to two years.

No method of transmission or storage is completely secure. While we work to protect your information, we cannot guarantee absolute security. If we become aware of a breach affecting your personal information, we will notify you as required by applicable law.

12. Children's Privacy
