Agreement to Terms

By accessing or using any services, website, landing pages, forms, or communications provided by MarkaScaling, you agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these terms, please do not use our services.

Marketing automation and follow-up systems

Appointment scheduling and booking

Client communication via SMS, email, and phone

CRM management and pipeline tracking

These services are delivered using GoHighLevel as our primary platform, supported by Meta, Retell AI, and Stripe for payments.

User Responsibilities

By using MarkaScaling's services or submitting your information through any of our forms, landing pages, or booking tools, you agree to:

Provide accurate, complete, and current information

Keep your contact information up to date

Use our services only for lawful purposes

Not misrepresent your identity or business

Not submit false or fraudulent information through any of our forms

Notify us promptly at [email protected] if you believe your information has been compromised

You are responsible for maintaining the confidentiality of any account credentials associated with our services and for all activity that occurs under your account.

Acceptable Use

You agree not to use MarkaScaling's website, services, or communications systems to:

Impersonate any person or entity or misrepresent your affiliation with any person or entity

MarkaScaling reserves the right to terminate access to any individual or entity found to be in violation of these acceptable use standards.

SMS Messaging Terms

MarkaScaling uses SMS messaging as part of our client communication, lead follow-up, and appointment management process. By submitting your phone number through any of our forms, landing pages, or booking tools, you expressly consent to receive text messages from MarkaScaling at the phone number provided.

Types of messages you may receive include: When you opt in to receive SMS messages from MarkaScaling, you can expect to receive appointment reminders and confirmations, follow-up messages related to your inquiry or lead generation services, promotional offers and marketing updates, and general service communications related to your relationship with MarkaScaling.

Opt-Out Instructions: You can cancel the SMS service at any time. Just text STOP to 610-808-1910. After you send the SMS message STOP to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Carrier Liability Disclaimer: Carriers are not liable for delayed or undelivered messages.

Message Frequency: You will receive messages on an appointment-based schedule, with additional follow-up messages based on your inquiry and engagement with MarkaScaling. Frequency may vary depending on your stage in the client journey. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Consent is not a condition of purchase. You are not required to consent to SMS communications in order to receive services from MarkaScaling.

SMS opt-in data and consent will not be shared with any third parties for marketing or promotional purposes.

Payments & Billing

MarkaScaling uses Stripe to securely process all payments. By agreeing to our services and submitting payment information, you authorize MarkaScaling to charge the agreed-upon fees for services rendered.

All fees are due as outlined in your service agreement or proposal

Payments are processed securely through Stripe and are subject to Stripe's Terms of Service

MarkaScaling does not store full credit card or banking information on its own systems

Refunds, if applicable, are handled on a case-by-case basis and are subject to the terms outlined in your individual service agreement

Failure to make timely payments may result in suspension or termination of services

Intellectual Property

All content, materials, branding, copy, funnels, campaigns, graphics, and other creative assets produced by MarkaScaling on behalf of clients remain the intellectual property of MarkaScaling until payment in full has been received, at which point ownership transfers to the client as outlined in the applicable service agreement.

MarkaScaling's own website content, brand name, logo, and proprietary systems remain the exclusive intellectual property of MarkaScaling and may not be copied, reproduced, or used without prior written permission.

Disclaimers

MarkaScaling provides marketing and lead generation services with the goal of helping clients grow their businesses. However, we make no guarantees regarding specific results, revenue outcomes, lead volume, or return on ad spend.

Our services are provided on an "as is" and "as available" basis. MarkaScaling makes no warranties, express or implied, regarding the reliability, accuracy, or fitness of our services for any particular purpose.

Results may vary based on market conditions, client industry, budget, and other factors outside of MarkaScaling's control.

Limitation of Liability

To the fullest extent permitted by applicable law, MarkaScaling and its team members, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, including but not limited to loss of revenue, loss of data, or business interruption.

In no event shall MarkaScaling's total liability to you exceed the total amount paid by you to MarkaScaling in the three months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless MarkaScaling and its officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of our services, your violation of these Terms of Service, or your violation of any applicable law or third-party rights.

Termination

MarkaScaling reserves the right to suspend or terminate your access to our services at any time, with or without notice, for conduct that we believe violates these Terms of Service, is harmful to other clients, our team, or our business, or for any other reason at our sole discretion.

You may terminate your service agreement with MarkaScaling at any time by providing written notice to [email protected], subject to the terms and conditions of your individual service agreement.

Upon termination, your right to use MarkaScaling's services will immediately cease.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States and the state in which MarkaScaling operates, without regard to conflict of law principles. Any disputes arising under these terms shall be resolved through good-faith negotiation, and if necessary, through binding arbitration or the appropriate courts of jurisdiction.

Changes to Terms

MarkaScaling reserves the right to update or modify these Terms of Service at any time. When changes are made, we will update the "Last Updated" date at the bottom of this page.
